Курбанов Р.А. Правовое регулирование в сфере разведки, добычи и транспортировки нефти и газа (США)

Аннотация: В статье проведен анализ становления и развития законодательства в сфере разведки, добычи и транспортировки нефти и газа в США с начала XX века до настоящего времени. Являясь одним из крупнейших потребителей энергии в мире, США обладает весьма незначительными собственными запасами энергоресурсов и, как следствие, энергетический сектор США полностью зависит от импорта энергоресурсов. За историю развития энергетический сектор США пережил не один кризис, что потребовало разработки на федеральном уровне соответствующей энергетической политики. Отдельное внимание в статье уделяется вопросам распределения полномочий по регулированию данного сектора между федеральной властью и властями штатов. Нельзя не признать, что экологические императивы играют важную роль в развитии в том числе и энергетического законодательства во всем мире. Эти тенденции также коснулись и энергетического сектора США, где в последнее время на федеральном уровне предпринимается ряд мер, направленных на развитие более экологичного газового сектора.

Abstract: The author of the article carries out the analysis of formation and development of the legislation in the sphere of exploration, production and transportation of oil and gas in the USA from the XXth century to the present time. Being one of the largest energy consumers in the world, USA has very scarce reserves of energy resources of their own. As a consequence, the energy sector of the USA fully depends on the import of energy resources. While it has been developing, the energy sector of the USA has undergone several crises which created the need for developing a certain energy policy at the federal level. The author of the article pays special attention at the questions of distribution of authority on regulation of this sector between the federal power and local powers of states. We can’t deny that the environmental imperatives also play an important role in the development of the energy legislation all over the world. These tendencies can be viewed in the energy sector of the USA too where a number of measures aimed at development of a more sustainable gas sector have been undertaken recently.
